Terms of Service

Welcome to SWOTPal. By accessing or using the SWOTPal website (swotpal.com), iOS application, API, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

SWOTPal is operated by ElevenApril (“we,” “us,” or “our”).

1. Description of Service

SWOTPal is an AI-powered platform that helps users create professional SWOT (Strengths, Weaknesses, Opportunities, Threats) analyses. The Service includes:

  • AI-generated SWOT analysis from text, PDF, resume, LinkedIn profile, or webpage input.
  • A dashboard to manage, edit, and export your analyses.
  • Free tools for quick SWOT generation.
  • Integration capabilities via MCP Server, CLI, and API.
  • Example analyses and templates for learning and reference.

2. Eligibility

  • You must be at least 13 years old to use the Service.
  • If you are under 18, you must have parental or guardian consent.
  • By creating an account, you represent that the information you provide is accurate and complete.

3. Accounts and Registration

  • You may register using email, Google, or Apple sign-in.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at support@elevenapril.com if you suspect unauthorized access.

4. Free and Paid Plans

Free Plan

  • Includes a limited number of AI-generated SWOT analyses per month.
  • Access to basic features and free tools.

Paid Plans (Premium / Ultra)

  • Offer higher usage limits, advanced features, and priority support.
  • Pricing and plan details are available at swotpal.com/#pricing.
  • Subscriptions are billed monthly or annually via Stripe.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial billing periods, except as required by applicable law.

iOS In-App Purchases

  • Subscriptions purchased through the iOS app are processed by Apple.
  • Apple's payment terms and refund policies apply to in-app purchases.
  • To manage or cancel an iOS subscription, go to Settings > Apple ID > Subscriptions on your device.

5. User Content

  • Ownership — You retain ownership of the content you input into SWOTPal.
  • License — By submitting content, you grant us a limited license to process it for the purpose of generating your SWOT analysis.
  • AI Output — You may use AI-generated analyses for personal or commercial purposes. However, AI-generated content is provided “as-is” and should not be treated as professional advice.
  • Responsibility — You are solely responsible for the content you input and how you use the generated output.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Upload malicious content, malware, or attempt to compromise the Service.
  • Abuse the API or automation tools to exceed rate limits or disrupt the Service.
  • Impersonate another person or entity.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell or redistribute the Service without our written consent.
  • Use the Service to generate content that is harmful, defamatory, or infringes on the rights of others.

7. Intellectual Property

  • The SWOTPal name, logo, website design, and all original content are the intellectual property of ElevenApril.
  • You may not use our trademarks without prior written permission.
  • Open-source components used in SWOTPal are governed by their respective licenses.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Disclaimers

  • The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
  • We do not guarantee that AI-generated analyses will be accurate, complete, or suitable for any specific purpose.
  • SWOTPal is not a substitute for professional business consulting, financial advice, or strategic planning.
  • We do not warrant uninterrupted or error-free operation of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, ElevenApril and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless ElevenApril, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

  • You may delete your account at any time.
  • We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.
  • Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

13. Service Changes

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes shall be resolved through friendly negotiation first. If negotiation fails, disputes shall be submitted to the competent court in the jurisdiction where ElevenApril is registered.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Your continued use after the effective date of changes constitutes acceptance of the updated Terms.
